Read the following carefully and understand our policies
"We/Us/Company/tvi/Travelvista India" means “Asthaa Infra Lifestyle Private Ltd.” and the Website www.travelvistaindia.com
Asthaa Infra Lifestyle Private Ltd (CIN: U70101AS2015PTC012068) is a company registered in India having its registered office at Zoo Road Tiniali, 9th Bye Lane, 3/D Nirupama Housing Complex, Guwahati 781024, Assam and owns the brand name “Travelvista India” and the logo published in the Website and marketing materials (Digital and Printed).
"You"/"Client" means the person/persons/company/institution or anybody, in whose name or on whose behalf the booking is made with us.
Please read these carefully. They set out the Terms & Conditions of the Agreement between You and Travelvista India, where, if we are acting as principal OR with our supplier where we are acting as an Agent.
Relationship between Company and Client: Where you have purchased separate travel components at separate prices sourced from different or the same supplier; any liability for defective services, death, injury or illness caused by either the negligence of the supplier, its agents or subcontractors or otherwise will not be liability of Travelvista India and will require you to claim against the supplier of the service concerned.
Your relationship with Travelvista India and whether we are a principal in direct contract with you, or the agent of another party will depend on what you buy; these terms are defined below and separate booking conditions apply to each type of booking:
1. Package Holiday Offered by Travelvista India: This is where you purchase through us holiday packages which are put together by us as a pre arranged combination and sold or offered for sale at an inclusive price. It is not a Package Holiday where you have selected different travel components which you instruct us to combine and which are offered to you separately at separate prices. Should you proceed to purchase the different and individually priced travel components or a combination of them, we will not have sold you a "Package" and we will act only as agents for those suppliers and you will have separate contracts with each supplier of those travel components (flights/transport, accommodation or other tourist services) that you have selected. If we have sold or offered to sell a Package Holiday to you then the following Booking Conditions will apply.
1.1. Your Holiday Contract: When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. If you are booking for a group you are ultimately responsible for paying the holiday invoice, even though by booking on behalf of the group, you are representing that each group member accepts that they are bound by this Agreement. A contract will exist as soon as any payment is received and we issue our confirmation invoice. This contract is made on the terms of these booking conditions and (the both the parties) we both agree to submit to the exclusive jurisdiction of the appropriate Courts situated at Guwahati, Assam, India. You should also refer to our website www.travelvistaindia.com for any updated information or changes concerning your holiday that may have occurred since you booked your holiday and where these conditions are also available.
1.2. Overnight stays:
1.2.1. Bookings: Hotels/Homestays/Resorts/B&B bookings are either directly purchased from the hotel or from a supplier at separate prices on the monies you pay us and we are acting as an Agent only, the same will not be protected in the event of either of our or any supplier's insolvency.
1.2.2. Photo-ID’s: Hotels/Homestays/Resorts/B&B insist on photo-identification of the clients for security purposes. You would have to carry a valid photo identification document issued by the government (e.g. Passport, Driving License etc). If you are a foreign national, having and displaying of a valid Passport and Visa is mandatory.
1.2.3. Service issues: In case of any issues with the services at the hotels, kindly inform the reception / duty manager immediately. Also, please inform Travelvista India client relationship manager assigned to you.
1.2.4. Change of Hotels: In some cases, we reserve the right to provide alternate Hotels/Homestays/Resorts/B&B of the same category based on the availability.
1.2.5. Check-in and Check-out Timings: Early check in and late checkout is always subject to availability at the Hotels/Homestays/Resorts/B&B and can never be guaranteed under any circumstances.
1.2.6. Services availed and issues: All baggage and personal effects are at all times and under all circumstances your responsibility. We will not be responsible or liable in case of loss of such items from the hotel premises / coach / Airport / during travel or place of visit etc. Some Hotels/Homestays/Resorts/B&B offer the facility of safe deposit lockers, which can be availed of by you at your own cost and risk. We will not be liable for any loss/theft from the same. Any damages caused to the hotel rooms / Coach / place of visit etc. during your stay / tour / visit, shall be borne and payable by you, and We will not be liable for the same. We shall not be liable if there is sudden disruption/disorder of telephone, internet services, and other amenities while staying at the Hotels/Homestays/Resorts/B&B. We will also be not responsible for the facilities provided or not provided in the room/bathroom/hotel premises etc. by the Hotels/Homestays/Resorts/B&B or its staff. Rude or Unprofessional behavior of Hotels/Homestays/Resorts/B&B staff does not come under the direct purview of the Company and the Company will not be responsible for the same. Facilities like mini bar, pay television channels, telephone etc are not complimentary and these facilities if used by the Client have to be paid for by the client directly to the Hotels/Homestays/Resorts/B&B and such charges are not included in the tour cost. The Client will have to abide by the check in /check out time of the Hotels/Homestays/Resorts/B&B. Any change made directly by the Hotels/Homestays/Resorts/B&B come under their direct purview and we will not be liable for any compensation due to this change.
2. Tour Operator Packages (Applicable to packages and activities outsourced by Travelvista India):
2.1 Direct contract with the Tour Operator: If you purchase a Outsourced Tour Operators Package or Activity (which will be explicitly mentioned in the travel itinerary) you will enter a direct contract with the Tour Operator and their Terms and Conditions will apply to your booking. They will advise you to the extent of their liability for the performance of the holiday arrangements and claims for death illness or injury occurring during your holiday.
2.2 Liability of your holiday arrangements: Travelvista India acts solely as the Agent for the Tour Operator who has organized your tour package. Accordingly Travelvista India has no liability for the performance of your holiday arrangements which are matters entirely between you and the Tour Operator and their booking conditions.
2.3 Booking Conditions: All booking conditions for our featured Tour Operators are available from us on request but will usually be available to you in the Tour Operators brochure or on their website.
3. Vehicles:
Travelvista India does not operate Car services of its own. It has tied up with many aggregators in order to provide a comprehensive choice of vehicles, departure times and prices to customers.
4. Booking Conditions: Please read carefully and understand the contents of the Itinerary, the ‘Terms and Conditions’, How to Book Rules, Price Grid and such other documents as may be applicable, as all these will form part of your contract with us once you effect the booking. Anything that is explicitly not mentioned in the inclusions and optional as suggested in the itinerary, are not a part of this package. Images shown about the place, city, hotel, attractions, etc. are for illustration purpose only and may not be the same as linked to the itinerary or services provided. Hotels mentioned in the itinerary or at the time of booking are subject to availability. We shall be in our right to change the hotels of similar or higher star category as booked in the itinerary . All rates mentioned are indicative only and are subject to change without prior notice.
4.1. Acceptance of terms: To effect the booking, Company may require you to tick on check box of Agree with the terms & conditions, tick marking on the checkbox means that you have read and understood the terms and conditions. Upon executing the Booking and on payment of the prescribed non-refundable interest-free booking amount, a binding contract shall come into existence.
4.2. Proper representation: Company advises you to ensure, before making a booking, that you have and / or you will be able to provide all the required valid and genuine documents and your professional qualifications to enable you to apply for visa, insurance etc.
4.3. Documentation required: Please go through the Website and check from our staff to ascertain the required documentation. Please note that guests other than tourist are not to be invited on tour by any tourist and they are not allowed to use any of the services of the tour.
4.4. Change in price: We reserve the right to alter the prices of any of the holidays we have advertised. You will be advised of the current price of the holiday that you wish to book before your booking is confirmed. Please see our website at www.travelvistaindia.com or call our client relationship manager or email us at helpdesk@travelvistaindia.com for our latest pricing indications and for the latest updates on the facilities and amenities at your selected accommodation and information about the transportation and other services. Service Tax or any other taxes that may apply will be charged extra at the time of booking.
4.5. Payment on time: Other than where you may book by paying a deposit with a balance of the cost to follow (see below) when you make your booking you must pay the full price you have been given immediately. If for any reason we are not paid on time, your tour shall be deemed as cancelled by you, and we shall cancel your travel arrangements. If you cancel, the cancellation charges applicable as per the type of booking, the same is specified to you via written email communication at the time of booking and the same is also available in the Website.
4.6. Non Payment of balance money: The price of your travel arrangements are calculated using exchange rates as mentioned in each package if you are a foreign national touring India or on any international tour arranged by Travelvista India. We will advise you at the time of booking if you may pay a deposit of 50% to book with the balance of the price to follow or 100% of the package price. Where a booking is done by payment of deposit, the balance of your travel arrangement cost must be paid by no later than 30 days before the commencement of the holiday or the time as indicated by our travel counselor, whichever is earlier. If the balance is not paid in time we shall retain and forfeit your deposit. If the deposit and/or balance are not paid on time we shall cancel your travel arrangements. Please see the cancellation charges mentioned in the terms and conditions of the product mentioned on the website at the time of booking.
4.7. Changes in Cost: Changes in transportation costs such as fuel, duties taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports and exchange rates mean that the price of your travel arrangements may change after you have booked. The amount of change will be communicated to you well in Advance and you will have to pay the same at least 7 days before commencement of the holiday. However there will be no change within 30 days of the commencement of the holiday.
4.8. Telephonic Bookings: Many of our bookings are taken directly by telephone when spelling and other errors may be made. It is a condition of our contract with you that you carefully check our confirmation immediately this is received to ensure that the names of all passengers are correctly spelt and are identical to the names shown in the passport (including the initial or first name), and the dates and time of travel, departure, arrival cities and other relevant information. You should check the confirmation for accuracy and that the travel details match what you have booked. If there is any discrepancy you are required to notify us or your travel agent within 48 hours and to take a note of who you report it to. We cannot be responsible if you do not advise us of any discrepancy unless you follow this procedure.
4.9. Mode of payment: Payments to us are usually required by NEFT/RTGS/Cheque/Demand Draft/Credit/Debit Card/SWIFT TRANSFER. For payment by Credit or Debit Card you undertake to us that you are at least the age of 18 years and have the authority to use the card or billing account details you provide to us for the purpose of settling any payments you owe to us for the services to be provided to yourself and those other persons named on the booking on whose behalf you are legally entitled to act. Please refer to our Privacy Policy for details of our security arrangements for card and other payment data and the manner in which we keep your personal data.
4.10. Amendments and/ or Cancellations:
4.10.1. If You Amend Your Booking: Changes in booking are not permitted. However, if there are any changes an amendment fee will be applicable and will be communicated before any changes can be done. The amendment fees will have to be paid by the client before the changes are done. If after our booking confirmation or invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing (by an email) from the person who made the booking. You will be asked to pay an administration charge of Rs. 2,000 per person and any further cost we incur in making this alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Where changes are possible we will issue a revised invoice including all additional charges. Any passenger name or spelling changes are not permitted and are treated as a cancellation. Any amendments to your booking shall be quoted once your request for an amendment is received. Please note it may not be possible to make amendments as required, and in that case if you wish to cancel your booking, the cancellation policy as mentioned herein shall apply. Any change in itinerary or upgrade in hotel/s will be charged extra, over and above the given cost (which will be informed to the customer in advance for final acceptance and payment).
4.10.2. Note: Certain travel arrangements (e.g. APEX / Non Refundable tickets) may not be changeable after a reservation has been made and any alteration request could incur cancellation charges of up to 100% of that part of the arrangements.
4.10.3. If You Cancel Your Holiday: You or any member of your party, may cancel your travel arrangements at any time. Written notification (by an email) from the person who made the booking on your behalf must be received at our offices. Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges as per Cancellation Policy mentioned on the Website. Please note that some travel arrangements such as APEX or non refundable tickets carry 100% cancellation charges and no refunds can be made.
4.10.4. If We Change or Cancel Your Holiday: It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you or your of them at the earliest possible date. No compensation or refund is payable where a minor change is made. We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel it. However, we will not cancel your travel arrangements less than 4 weeks before your commencement date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us; if available (We will refund any price difference if the alternative is of a lower value). If it is necessary to cancel your travel arrangements, we will refund you the amount that you paid to us without any interest.
4.10.5. All flight bookings, if any, would be done through our ticketing partner and we will advise you of the identity of the airline at the time of booking or when this becomes known to us. Any changes to the actual airline after you have received your tickets will be notified to you as soon as possible and in all cases at check-in or at the boarding gate. Such a change is a minor change. Other examples of minor changes include alteration of your outward/return flights by less than 24 hours, changes to aircraft type, change of accommodation to another of the same standard, or a change to your departure airport. We do not have to tell you about minor changes before you go on holiday and we will not pay compensation. If we make a major change to your holiday, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements from us if available or cancelling your booked holiday and receiving a refund of monies paid as per Cancellation Policy. If you do not wish to take the alternative we offer you, you can choose another holiday from us and pay, or receive a full refund of any price difference.
4.10.6. Cancellation Policy: We understand that due to certain unavoidable circumstances you may need to cancel your visit and we will take requisite steps to ensure a smooth and hassle free cancellation process. Do write to us at helpdesk@travelvistaindia.com and we will process your cancellation.
Booking Refund will be processed as:

Cancellation more than 30 days prior to Tour Start Date = 75% Refund of Booking Amount paid to us

Cancellation less than 30 days prior to Tour Start Date = 50% Refund of the total package amount

Cancellation less than 15 days prior to Tour Start Date = No Refund
4.10.7. Supplier Change and Cancellation Fees: Cancelled bookings may also incur supplier fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Where we incur any liability for a supplier cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee. Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from that supplier.
4.10.8. Force Majeure: This means that we will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport. Whilst we will always offer assistance to our customers to ensure their wellbeing and safety we are not responsible for any additional costs or expenses incurred where you might be unable to travel due to the consequences of the Force Majeure. Itineraries are based on information available at the time of planning and are subject to change. We reserve the right to change or cancel tour dates, people or itineraries as conditions may require. This is only for the safety of our guests. Travelvista India is not responsible for any expenses incurred by tour members in preparing for the trip, including non refundable or penalty-carrying airline tickets, special clothing, visa or passport fees, or other trip-related expenses.
4.11. For Flight Bookings: In case of amendments or cancellations of flight bookings made through our ticketing partner, the rules and regulations of the respective Airlines apply. Charges, penalties and other charges are levied by the respective Airlines. The same can be obtained from the respective Airlines websites or by calling their Customer Care centre.
4.12. For Bookings done with Deal codes or Promotions: Travelvista India may run promotions with or without Deal codes or also give discounts or offers. In such cases, where the booking is done using one or many of such Promotional offers, deal codes or discounts and the said booking is then cancelled, the amount of discount availed at the time of booking using the offer or deal combined will be deducted over and above the cancellation charges as per Cancellation Policy of the service booked mentioned on the Website at the time of booking.
4.13. Refunds: Allthough, Travelvista India process all refunds arising from any transactions due to any cancellation of the booking or any reason whatsoever within 2-3 working days (after deducting the applicable charges) in the same bank account or debit or credit card used by the Client to make the payment at the time of booking, it may take 15 to 20 days to reflect in the clients Accounts due to the Bank's processess.
4.14. Passports & Visas: All foreign national travelers must have a valid passport for international travel to India. When assisting with an international travel booking, we will assume that all travelers on the booking have a valid passport and Indian Visa. If this is not the case, you must let us know. It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent caused by fault on our part). If you need information regarding visas, passports and other travel document requirements for your trip, please let your client relationship manager know. We can provide you with general information on visa and passport requirements that apply to foreign national travel bookings you make with us. Our client relationship manager can also obtain more specific information from an external visa advisory service provider on your behalf (if you wish, we can assist you to obtain visas through this external service and fees will apply). We do not warrant the accuracy of information provided by any external service and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).
4.15. Travel Insurance: We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Travel insurance is also strongly recommended by the Government for all travel. You must obtain a Financial Services Guide/Product Disclosure Statement relating to the travel insurance product you are considering purchasing and should read that document before making any decision about whether to acquire the product. We can provide you with general information about the travel insurance options available to you. To purchase travel insurance through us, contact your client relationship manager. In order for us to arrange your insurance, you must confirm that you have read and understand the applicable Financial Services Guide/Product Disclosure Statement, and understand the limits on your cover and your duty of disclosure to the insurer. If you decline travel insurance, you may be required to sign a disclaimer.
4.16. Travel Advice: We recommend that you contact the Ministry of External Affairs or visit their website at www.mea.gov.in for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit. Health: You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel.
5. Liability: In case of any booking that may incur a technical error or any fare difference due to technology challenges or otherwise arises, we shall be within our right to raise that demand within 48 hours of the booking. In case the difference of amount is not paid, the booking shall be cancelled and the original amount shall be refunded to you without any charge from our side or liability to us. You shall be within your right to pay the difference as demanded and get the booking vouchers / tickets.
To the extent permitted by law, neither Travelvista India nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Indian Consumer Law). This liability clause is subject to your rights under the Indian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Consumer protection Act 1986. Travelvista India is not liable / responsible for any damages, costs, expenses, losses, or claims which are attributable to the fault of yours, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services that form any part of the Tour(s), or a Force Majeure event (as defined).
In the event that any deficiency, loss, death, injury or illness is caused by the negligent acts and/or omissions of Travelvista India or of the third-party suppliers of any services which form part of the Contract, then Travelvista India limits its liability, where applicable by all applicable International Conventions Carriage of Clients and their luggage by sea is governed by the Athens Convention which is expressly incorporated into these Terms & Conditions and any liability of Travelvista India and/or the Carrier for death or personal injury or for loss or damage to luggage arising out of carriage by sea shall be determined solely in accordance with this Convention. The Athens Convention limits the Carrier's liability for death or personal injury or loss or damage to luggage and makes special provision for valuables. It presumes that luggage has been delivered undamaged to the Guest unless written notice is given to Travelvista India and/or the Carrier:
1. In the case of apparent damage, before or at the time of disembarkation or redelivery; or
2. In the case of damage which is not apparent or of loss, within 15 days from the date of disembarkation or redelivery or from the time when such redelivery should have taken place. Any damage payable by Travelvista India up to the Athens Convention limits shall be reduced in proportion to any contributory negligence by the Client and by the maximum deductible specified in Article 8 (4) 01 of the Athens Convention.
6. Jurisdiction: In the event of a dispute arising out of or relating to this contract, including any question regarding its existence, validity or termination, the parties shall first seek settlement of that dispute by mediation in accordance with the applicable rules. The Mediator shall be appointed by Travelvista India. If the dispute is not settled by mediation within thirty (30) days of the appointment of the mediator, or such further period as the parties shall agree in writing, then the dispute shall be settled in accordance with the Arbitration and Conciliation Act, 1996 by a sole Arbitrator to be appointed by Travelvista India .The Arbitration proceedings should be held in Guwahati, Assam. The arbitrator's decision shall be final and binding on both parties. In case of any dispute concerning the award the courts in Guwahati alone shall have exclusive jurisdiction. This contract will be governed by Indian law. You agree that in the event of a dispute or difference between the parties the exclusive jurisdiction shall vest in the competent court / forum / tribunal in Guwahati only.
7. Privacy of Information: We try to maintain the privacy of the personal information provided by you. However, it would be necessary for us to share this information with Consulates, Embassies, Hotels and other service providers who would be providing you service during the tour. We would also be constrained to disclose such information if we receive an order of the court, a requisition from any government or statutory authority, subpoena, or under any law, rules or regulations, such disclosure becomes necessary. You agree to let us photograph and / or videograph the tour and specifically you agree to let us photograph and / or videograph you in the course of the tour. You consent to any such pictures being taken and agree that you hereby grant a perpetual, royalty-free, worldwide, irrevocable license to Travelvista India, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to you or compensation payable to you. You agree and accept that all such photographs and / or videgraphs and statistics are our absolute property of Travelvista India and we have the unrestricted right to use them for any legitimate purposes including advertisement and commercial purposes. Further, you agree that if you share with us any photographs and / or videographs taken by you during the tour, we would be free to publish such photographs and / or videographs through all media including print media, websites, letters, emails etc.

8. Amendments and Severability: The latest Terms, as amended, may be accessed any time on Travelvista India’s website at, or will be sent to Client upon their written request to Travelvista India. If any provision of these Terms is found to be so broad as to be unenforceable, such provision shall be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any other provision.
9. Interpretation: As to the interpretation of the aforesaid terms and conditions, our decision shall be final and binding upon you. We reserve the right to change the Terms & Conditions any time without any prior notice
TERMS OF USE
This "Terms of Use" applies to the entire contents of the Website under the domain name www. travelvistaindia.com and to any correspondence by e-mail between you and us. Please read these terms carefully before using the Website. Using the Website indicates that you accept these terms regardless of whether or not you choose to register with us. If you do not accept these terms, do not use the Website. This notice is issued by the Company.

1.1. You may access most areas of the Website without registering your details with us. Certain areas of the Website are only open to you if you register.
1.2. By accessing any part of the Website, you shall be deemed to have accepted this legal notice in full. If you do not accept this legal notice in full, you must leave the Website immediately.

You should check the Website from time to time to review the then current legal notice, because it is binding on you. 2.2.
